Article 1 (Purpose)
The purpose of these Terms of Service (hereinafter referred to as the "Terms") is to prescribe the rights, obligations, responsibilities, and other necessary matters between KoreaMediPass Co., Ltd. (hereinafter referred to as the "Company") and users in connection with the use of all services provided through "KoreaMediPass" (hereinafter referred to as the "Platform"), a medical and health checkup connection platform for foreign patients and overseas Koreans operated by the Company.
Article 2 (Definitions)
① The definitions of terms used in these Terms are as follows:
"Platform" refers to the virtual business place established by the Company using information and communication facilities (such as websites) to broker and provide domestic medical institution information, health checkup and treatment reservation coordination, checkup result reports, and other supplementary services to Users.
"User" refers to any person who accesses the Platform and uses the services provided by the Company in accordance with these Terms.
"Member" refers to a person who has registered as a member by providing personal information to the Platform and is entitled to continuously use the services provided by the Platform.
"Group Member" refers to a Member who belongs to an organization partnered with the Company (such as travel agencies, associations, or corporations) and has registered through the respective organization.
"Partner Medical Institution" refers to a medical institution within the Republic of Korea that has entered into a partnership agreement with the Company, provides medical treatment and health checkup program information through the Platform, and renders actual medical services according to User reservations.
"Checkup Package" refers to a health checkup program provided by a Partner Medical Institution that can be prepaid via the Platform.
"Optional Checkup Item" refers to an additional checkup item that a User may select upon reservation in addition to the Checkup Package.
"On-Site Additional Checkup Cost" refers to costs incurred on the day of the checkup for additional tests, procedures, certificate issuances, etc., which were not included in the prepaid amount.
"Medical Intermediation/Facilitation Service" refers to the service in which the Company, as a registered foreign patient facilitator under Article 27-2 of the Medical Service Act, supports consultation intake, booking assistance, and schedule coordination between Users and Partner Medical Institutions.
② Definitions of terms not specified in these Terms shall follow relevant laws and regulations, as well as individual service guidelines.
Article 3 (Specification and Revision of Terms)
① The Company shall post the contents of these Terms, company name, representative's name, business address, phone number, email address, business registration number, mail-order business report number, and foreign patient facilitator registration number on the initial screen of the Platform so that Users can easily identify them.
② The Company may amend these Terms to the extent that it does not violate relevant laws, including the Act on Consumer Protection in Electronic Commerce, the Regulation of Standardized Contracts Act, the Act on Support for Overseas Expansion of Healthcare and Attraction of International Patients, and the Personal Information Protection Act.
③ When amending these Terms, the Company shall announce the effective date and reasons for the amendment alongside the current Terms on the Platform's notice board from at least seven (7) days prior to the effective date until the day before the effective date. However, if the amendments are disadvantageous to Users, the Company shall provide a prior grace period of at least thirty (30) days and notify Users individually via electronic means (such as email).
④ The Company shall record and maintain the version of the Terms agreed to by the Member and the date/time of consent.
Article 4 (Provision and Content of Services)
① The services provided by the Company include:
Multilingual information provision and search services regarding domestic Partner Medical Institutions and health checkup programs;
Intake, schedule coordination, and reservation agency services for medical appointments and checkups;
Payment support services for checkup fees and additional checkup costs;
Transmission and viewing services for checkup result reports issued by Partner Medical Institutions;
Provision and transmission services for preliminary medical questionnaires;
Other user convenience support services determined by the Company.
② In principle, the Company provides services 24 hours a day, 365 days a year, unless there is a specific operational or technical impediment. However, services may be temporarily suspended for system regular maintenance, equipment repairs, etc., in which case prior notice will be given.
③ The Company may modify the content, methods of use, and operating hours of the services, and shall give prior notice regarding the reasons and details of any modifications.
Article 5 (Membership Registration and Account Management)
① A User applies for membership by filling in the membership information according to the form prescribed by the Company and expressing consent to these Terms and the Privacy Policy.
② The Company may refuse approval or terminate the service agreement retroactively for applications falling under any of the following items:
Applying under another person's name;
Providing false information or omitting information required by the Company;
Having previously lost membership eligibility due to a violation of these Terms;
Violating relevant laws or failing to satisfy the application requirements set by the Company.
③ The Company does not allow registration for children under 14 years of age. If a User is confirmed to be under 14 years old based on the birth date entered upon registration, membership will be restricted.
④ Members must promptly update any changes to their registered information through the profile edit page on the Platform.
⑤ Members are responsible for managing their account ID and password, and may not assign or lend them to any third party.
⑥ Date of birth and biological sex are fixed based on the information registered at the time of signup and cannot be modified arbitrarily by the Member, as they serve as criteria for identity verification and determining checkup items. If misrecorded, a Member may request a correction through the Company.
Article 6 (Withdrawal and Restriction of Membership)
① A Member may request withdrawal from the Platform at any time, and the Company shall process it without delay, except as otherwise required by relevant laws.
② If there are ongoing reservations or unpaid balances, withdrawal may be finalized after such matters are fully settled.
③ The Company may suspend service use or terminate membership qualifications after prior notice if a Member falls under any of the following items (notice may be given post-action in urgent circumstances):
Engaging in prohibited acts under Article 8;
Registering false information or misappropriating another person's information;
Repeatedly failing to honor reservations without justifiable grounds (No-Show);
Materially violating these Terms or relevant laws and regulations.
④ Even after withdrawal or disqualification, information subject to retention obligations under relevant laws and the Privacy Policy shall be retained for the designated retention periods.
Article 7 (Group Use)
① When multiple users apply for checkups through an organization such as a travel agency, association, or enterprise, the Company may process reservations and notifications through the corresponding organization.
② Even when applying for reservations through an organization, consent regarding the collection, use, and third-party provision of personal information must be obtained directly from the individual examinee; the organization cannot consent on their behalf.
③ If an organization's representative or manager provides personal information of affiliated users to the Company, the responsibility for securing legitimate authority and consent lies with the organization.
④ The standards for modification, cancellation, and refund of group reservations are subject to Article 11, identically to individual User applications.
⑤ The Company may provide separate benefits to Group Members, the details and conditions of which are posted on the Platform. However, such benefits cannot be combined with other promotions.
Article 8 (User Obligations and Prohibited Acts)
① Users shall not engage in any of the following acts when using the Platform:
Registering false information (identity theft, falsified medical history, fraudulent passport information, etc.) during membership registration or reservation;
Impersonating the Company's management, staff, or representatives of Partner Medical Institutions;
Duplicating, distributing, or commercially exploiting information posted on the Platform without authorization;
Disrupting clinic operations by repeatedly committing intentional no-shows at Partner Medical Institutions;
Stealing another person's account or accessing another person's medical/checkup information without authorization;
Any acts that violate relevant laws, these Terms, or public order and good morals.
② For the accuracy and safety of checkups, Users must truthfully disclose matters that may affect the examination, such as medical history, current medications, allergies, and pregnancy status. The Company shall not be liable for any consequences arising from failure to disclose or false disclosure.
Article 9 (Platform Status and Limitation of Legal Liability)
① [Declaration of Non-Medical Institution Status] The Company is not a medical institution under the Medical Service Act. As a mail-order broker and foreign patient facilitator, the Company only brokers reservation coordination and supplementary services between Partner Medical Institutions and Users. Under no circumstances does the Company directly perform medical acts (diagnosis, prescription, procedures, surgery, reading/interpretation, etc.).
② [Attribution of Medical Liability] All legal and medical liabilities concerning the adequacy of medical services, treatment outcomes, medical malpractice, misdiagnosis, side effects, and therapeutic efficacy provided by Partner Medical Institutions belong to the respective Partner Medical Institution and the medical personnel who performed the medical acts. However, the Company shall be liable for damages caused by the Company's own intent or negligence.
③ [Nature of Provided Information] Medical information, checkup package descriptions, reviews, and other materials posted on the Platform are intended for general informational purposes and cannot substitute for professional medical diagnosis or consultation by a licensed physician.
④ [Nature of Checkup Result Reports] The checkup result reports transmitted by the Company are generated and issued by Partner Medical Institutions; the Company does not author or interpret the content. Inquiries and consultations regarding results must be directed to the relevant medical institution or medical personnel.
⑤ [Force Majeure] The Company shall not be held liable if services cannot be provided or reservations are canceled due to force majeure events, including natural disasters, infectious disease outbreaks, government immigration/travel restrictions, or unavoidable strikes, closures, or system failures of Partner Medical Institutions. In such cases, the full amount paid by the User shall be refunded.
Article 10 (Reservation and Payment)
① Users apply for reservations via the Platform by selecting a medical institution, checkup package, optional checkup items, preferred date/time, and examinee details.
② In principle, checkup package fees must be paid in full in advance upon application.
③ A reservation is officially registered upon completion of payment; however, the actual checkup date and time may be adjusted depending on the schedule of the Partner Medical Institution. In such cases, the Company shall notify and consult with the User in advance.
④ Payments are processed through an Electronic Payment Gateway (PG) designated by the Company. The Company does not directly store payment method details such as card numbers.
⑤ If the examinee information entered by the User (name, date of birth, biological sex, passport number, etc.) does not match the facts, the checkup may be restricted or refused, and any resulting disadvantages shall be borne by the User.
Article 11 (Cancellation and Refund of Reservations)
① A User may request cancellation of a reservation prior to the scheduled checkup date via the Platform or customer support channels, and shall receive a refund of the amount paid, excluding the deductions specified in Paragraph 4.
② Even if canceled on the day of the checkup or in the case of a no-show without prior notice, a refund will be issued excluding the deductions in Paragraph 4, provided the checkup has not commenced. However, to ensure smooth schedule management, Users should request cancellation or rescheduling at least three (3) days prior to the scheduled date.
③ If certain examinations cannot be performed on the day of the checkup due to the User's choice or physical condition (e.g., elevated blood pressure), a partial refund corresponding to the unperformed tests shall be provided.
④ The refund amount shall be the remaining balance after deducting the following items from the total amount paid:
Costs for tests already performed and items already provided up to the day of the checkup (such as bowel preparation medications for colonoscopy), as calculated and notified to the Company by the Partner Medical Institution;
Payment gateway cancellation fees incurred by the payment cancellation.
⑤ The Company shall process the refund after informing the User of the deduction details under Paragraph 4 and the expected refund amount.
⑥ In the event of objectively verifiable, unavoidable circumstances such as flight cancellations, entry refusals, or acute illnesses, the Company may review supporting documentation and issue a full refund without the deductions under Paragraph 4.
⑦ If a checkup cannot take place due to circumstances attributable to the Partner Medical Institution or the Company, a full refund of the paid amount shall be issued.
⑧ In principle, refunds are processed using the original payment method within seven (7) business days from the refund application date. Additional processing time may be required depending on the nature of the payment method (e.g., overseas credit cards). For payments made via cash/bank transfer, the User must submit account details under their own name.
⑨ Cancellations and refund settlements for checkups conducted under a group checkup agreement shall follow the terms of the contract between the respective organization and the Partner Medical Institution. However, if a User paid directly on the Platform under their own name, this Article shall apply.
⑩ The Company may restrict service access in accordance with Article 6 for Users who repeatedly fail to attend without prior notice.
Article 12 (On-Site Additional Checkup Costs)
① If additional checkup items, procedures (such as polypectomy discovered during endoscopy), biopsies, conscious sedation (sleep anesthesia), certificate issuances, etc., are performed on-site on the day of the checkup, such expenses are not included in the prepaid amount and must be borne separately by the User.
② The Company may receive the billing statement for additional checkups from the Partner Medical Institution and invoice the User. The invoiced amount follows the criteria set by the Partner Medical Institution.
③ The Company shall notify the User of the billed items, amount, and payment deadline via their registered email, and the User shall pay online through the Platform.
④ Discounts and promotional benefits applied to Checkup Packages do not apply to On-Site Additional Checkup Costs.
⑤ For overseas Koreans and foreign nationals, copayments or out-of-pocket expenses may arise under the Medical Service Act and national health insurance regulations; relevant details are provided during the reservation process.
⑥ Refunds for additional checkup costs will be processed after verification with the Partner Medical Institution. Fees for tests or procedures that have already been performed are non-refundable. Refund procedures mutatis mutandis apply Article 11, Paragraphs 5 and 8.
Article 13 (Issuance and Provision of Checkup Result Reports)
① Checkup result reports are authored and issued by Partner Medical Institutions, and the Company delivers them upon request by the User.
② Result reports are issued upon User request, and issuance may take up to two (2) weeks after the request is submitted.
③ If On-Site Additional Checkup Costs under Article 12 are not settled by the payment deadline, application for the issuance of the result report for that specific checkup may be restricted. The Company shall notify the User of this condition in advance during reservation and invoicing.
④ Users may only access their own checkup result reports, and the Company delivers the reports after verifying the User's identity.
Article 14 (Discounts and Promotions)
① The Company may offer discounts on Checkup Packages and Optional Checkup Items, the details, duration, and conditions of which shall be posted on the Platform.
② Discount benefits apply to Users who meet the posted conditions and may be restricted to logged-in Members.
③ The Company may modify or terminate discount benefits after prior notice. However, for reservations where payment has already been completed, the conditions in effect at the time of payment shall remain applicable.
④ In the event of reservation cancellation, the refund amount is calculated based on the actual discounted amount paid.
Article 15 (Protection of Personal Information)
① The Company protects Users' personal information in accordance with relevant laws such as the Personal Information Protection Act, and specific details are defined in a separate Privacy Policy.
② The Company provides User information to Partner Medical Institutions within the scope necessary to fulfill checkup reservations, subject to obtaining separate consent from the User.
③ The Company encrypts and stores Users' unique identification information and health-related sensitive data, restricts access strictly to authorized personnel, and records and maintains access logs.
Article 16 (Dispute Resolution and Governing Law)
① The Company shall promptly address opinions or complaints submitted by Users; if processing takes an extended period, the Company will notify the User of the reasons and processing schedule.
② The interpretation of these Terms and any disputes between the Company and Users shall be governed by the laws of the Republic of Korea.
③ Any litigation arising between the Company and Users in connection with service use shall be submitted to the competent court under the Civil Procedure Act of the Republic of Korea.
Article 17 (Language)
① The Company may provide these Terms in Korean, English, Japanese, Chinese, and Indonesian.
② In the event of any discrepancy or conflict between the translated versions and the Korean version, the Korean version shall prevail.
Addenda
① These Terms shall enter into force on October 1, 2026.
② These Terms shall also apply to service agreements entered into before the enforcement date. However, matters that occurred prior to the enforcement date shall remain governed by the previous provisions.
